A research study of ibrāhīm al-naẖaʿī’s juristic opinions narrated in the book al-muṣanaf by Ibn ābī shaībaẗ (From kitāb al-ṭahāraẗ at the end of kitāb al-zakāẗ )

Abstract

This article aims to study opinions of a famous Muslim jurist ibrāhīm al-naẖaʿī narrated by Ibn ābī shaībaẗ in his book known as” al-muṣanaf’’. ibrāhīm played a vital role in the development of Islamic jurisprudence and he is considered the leader of those jurists who depend upon the analogy in derivation of rules of Islamic law based on the texts of Quran and Sunnah. Unfortunately, in the history of Islamic jurisprudence his contribution in this regard has been remained neglected, although, the Hanfi jurisprudence has relied upon his juristic efforts and sometime he has been quoted in the Hanafi literature, because he was the grand teacher of Imam abū ḥanaīfaẗ. Therefore, I have tried to study his opinions and its impact on the Hanafi School of thought. For this purpose, I selected the book of Ibn ābī shaībaẗ, because, he have transmitted the opinions and fatāwa of prominent Muslim jurists who lived in the first century and have contributed in the discipline of Jurisprudence. Therefore, his book is considered a collection of Prophetic traditions as well as an authentic source of the ruling of first, second and third generations of Muslim jurists. The   method adopted in this research work is analytical and comparative based of the issues addressed by ibrāhīm al-naẖaʿī and ḥanafī jurists.
