Abstract

Vote is a modern democratic term.  The Holy Prophet, his Companions and the early centuries did not have such a term but they used the term of allegiance such as allegiance to Islam, allegiance to migration, allegiance to jihad, allegiance to piety and allegiance to caliphate and emirate.  There are different opinions of the scholars regarding the status, one of which is the opinion of Mufti Muhammad Shafi'i that the legal status of the vote is like the testimony.  He says that voting for a candidate in assemblies and councils is evidence although there is a big difference between vote and testimony and in this debate he has proved that there are 40 differences between vote and testimony so it is appropriate that the vote is in the status of qaza.
